only divorce, but also prenuptial agreements, business partnership
formations and dissolutions, and a variety of other types of
issues.
Prenuptial Agreements
Traditionally, people have gone to attorneys for their prenuptial
agreements. No matter how gentle the attorneys try to be, the
process of negotiating this type of agreement using separate
counsel can be devastating.
We have found over the years that all of the financial terms
of a prenuptial agreement, as well as any other matters that
our clients wish to include, can be negotiated without any acrimony.
Our policy with a prenuptial agreement, as with all other agreements
that we mediate, is to require our clients to have it reviewed
by outside attorneys before they sign it. The end result is
an agreement that is reached through a collaborative process,
not an adversarial one. The mediation serves as a process which
helps both parties clarify their expectations, and helps answer
unspoken questions in a safe environment.
Our "A-B Contract"
One service that we offer, which we believe to be unique to
Coast To Coast, is designed for couples who would prefer to
stay married, but feel that divorce is inevitable. We help them
agree upon the terms of their divorce and also upon what it
would take to build a successful, happy marriage. We call this
our "A-B Contract", because it is comprised of two
agreements...a Marital Settlement Agreement, which sets forth
the terms of a divorce, and a Marriage Agreement, which states
in clear terms the rights and responsibilities that each spouse
sees as important to a happy marriage. Couples who enter into
both of these agreements almost always end up choosing to remain
married. We hold onto their divorce agreement just in case they
change their mind, but that rarely occurs.
